Please read these Terms of Service ("Terms") carefully before using CommuteGraph. By accessing or using our service, you agree to be bound by these Terms.
1. Service Description
CommuteGraph is a web-based service that visualizes how commute times vary with departure time using traffic-aware routing data from Google Routes API. The service provides:
- Time window analysis of commute durations
- Interactive visualizations and insights
- Route preview maps
- Historical traffic pattern analysis
2. Use of the Demo
The CommuteGraph demo does not require an account. By using the demo, you agree to:
- Use the demo for personal, non-commercial exploration
- Be at least 13 years of age
- Comply with all applicable laws and regulations
3. Rate Limits and Fair Use
The demo uses pre-computed samples. We may apply reasonable technical limits to protect the site. Excessive automated access may be restricted.
4. Prohibited Uses
You agree not to:
- Use the service for any illegal purpose
- Attempt to bypass rate limits or access controls
- Reverse engineer, decompile, or disassemble the service
- Resell or redistribute data obtained from the service
- Use automated tools to scrape or harvest data
- Impersonate others or provide false information
- Transmit viruses, malware, or malicious code
- Interfere with or disrupt the service or servers
- Violate any applicable laws or regulations
5. Data Accuracy and Limitations
5.1 Estimates Only
CommuteGraph provides traffic-aware route estimates based on third-party data (Google Routes API). These are estimates and predictions, not guarantees. Actual commute times may vary due to:
- Weather conditions
- Accidents or road closures
- Construction or special events
- Day-to-day traffic variations
- Changes in traffic patterns over time
5.2 No Liability for Decisions
You acknowledge that CommuteGraph is a planning tool and should not be the sole factor in making important life decisions (e.g., accepting a job, purchasing a home). We are not responsible for any decisions made based on our data.
6. Intellectual Property
The CommuteGraph service, including its design, code, features, and content, is owned by CommuteGraph and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the service for your personal, non-commercial use, subject to these Terms.
7. Service Availability
We strive to provide reliable service, but we do not guarantee:
- Uninterrupted or error-free operation
- That the service will meet your specific requirements
- That defects will be corrected immediately
- Availability of third-party services (Google Routes API, etc.)
We reserve the right to modify, suspend, or discontinue the service at any time with or without notice.
8. Termination of Access
We reserve the right to restrict or block access to the demo if you violate these Terms or for operational reasons, at our sole discretion.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMMUTEGRAPH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED US DOLLARS (USD $100).
11. Indemnification
You agree to indemnify and hold harmless CommuteGraph and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or violation of these Terms.
12. Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
12.2 Arbitration
Any disputes arising from these Terms or your use of the demo shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the new Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
